| Conditions or Reasons: |
1) The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. REASON: In pursuance of Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. 2) The surfacing materials/finishes and edging to the path shall be as specified and shall not be altered without the prior written approval of the Local Planning Authority. REASON: To ensure the development does not prejudice the character or appearance of the surrounding environment. 3) The bridges, river wall, handrails, fencing, gates and barriers shall be provided in accordance with the approved plans and shall not be altered without the prior written approval of the Local Planning Authority. REASON: To ensure the development does not prejudice the character or appearance of the surrounding environment. 4) No lighting to the path and no associated structures, signage, refuse bins, seats or public art shall be installed before details have been submitted to and approved in writing by the Local Planning Authority. Thereafter such works as are approved shall only be carried out in accordance with the approved details unless subsequently otherwise approved in writing by the Local Planning Authority. REASON: To ensure the development does not prejudice the character or appearance of the surrounding environment. 5) During the period of construction works: All potentially contaminating materials shall be stored in accordance with the advice offered by the Environment Agency in order to avoid pollution of the water environment. All contractors on site must be made aware of the necessary procedures and requirements. If any contamination not previously identified is found to be present on site no further works shall take place without the written approval of the Local Planning Authority to a scheme and programme of remediation which shall thereafter be implemented. All contractors on site must be made aware of this requirement. No site buildings shall be erected, no equipment, materials or top soil shall be stored and no vehicles or machinery shall be routed through or parked within 3m of the top of the riverbank or between the proposed path and the top of the riverbank where the path is closer than that. If any reptiles or any other protected species are found within the construction area no further works shall take place without the written approval of the Council's Countryside Officer to measures for the protection, or if necessary translocation of such species. All contractors on site must be made aware of this requirement. REASON: The protection of the natural environment and the ecology of the site and surrounding environment. |

1) This decision relates specifically to drawings EK0233-07 Rev.B, EK0233-08 Rev.O, MI/186/B, CCC2826- 02, 03A, 04A, 05, 06 (location plan) & 06 (miscellaneous details) as supplemented by the information contained within the Agent's letter dated 21 May 2009. 2) This decision to grant planning permission subject to conditions has been made having regard to the South East Plan 2009 and the Canterbury District Local Plan First Review 2006 and, specifically, Policies BE1, C3, R12 and NE1 of the Canterbury District Local Plan First Review and Policies T2, T7 and C6 of the South East Plan and the other material considerations set out in the report of the Head of Development Services to the Development Control Committee on 23 June 2009. The permission is considered to accord with above development plan policies in that the general design and impact of the development is acceptable and the development compatible with existing uses, the development meets aims to provide improved, accessible and more sustainable links between the villages and City and the potential impact of the development on the character and appearance of the surrounding environment/landscape and its ecology is acceptable. 3) The Applicant is reminded of the requirements of the 1981 Wildlife and Countryside Act (as amended) and that the cessation of work on the discovery of any reptile or protected species is a legal requirement and applies to whoever carries out the work. Attention is drawn to the advice relating to mitigation measures offered by this Council's Countryside Officer, also to the opportunities available to enhance the ecological value of the site. |
