1) The development to which this permission relates must be begun not later than the expiration of three years beginning with the date on which this permission is granted. REASON: In pursuance of Section 91(1) of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004. 2) No work shall be commenced on any building phase before 1:50 elevational scale drawings of the principal elevations of that building have been submitted to and approved by the local planning authority. The building shall then be constructed in strict accordance with the approved plans. REASON: In the interests of the visual appearance and character of the development. 3) No work shall be commenced on any building phase before samples of materials to be used in the exterior of that building have been submitted to and approved by the local planning authority. REASON: In the interests of the visual appearance and character of the development. 4) Before the commencement of any works in connection therewith, details of the surfacing materials and design of all the squares, roads, paths, the riverside walk and other hard surfaces shall be submitted to and approved by the local planning authority. Such details to follow the principles shown on the submitted plans hereby approved. REASON: In the interests of the visual appearance and character of the development. 5) Before the commencement of any works in connection therewith, details of all gates, walls, railings and fences shall be submitted to and approved by the local planning authority. The development shall be carried out in strict accordance with the approved details. REASON: In the interests of the visual appearance and character of the development. 6) Prior to the commencement of the construction of the riverside walk, details shall be submitted to the local planning authority for approval of appropriate street furniture to be located on or adjacent to it. Such details to include seats, bins, directional posts and signs, information boards and lighting. The approved street furniture shall be provided within 3 months of the completion of the riverside walk. REASON: In the interests of the visual appearance and character of the development. 7) Before the commencement of any works in connection with new highway work, details of all street lighting shall be submitted to and approved by the local planning authority. The development shall be carried out in strict accordance with the approved details. REASON: In the interests of the visual appearance and character of the development. 8) Insofar as not already approved, within three months of the development commencing a landscaping scheme for the site shall be submitted to the local planning authority for approval. The scheme shall include:- (a) A schedule and plan to show the precise location, species, size, crown spread and condition of all trees and shrubs within and on the boundary of the site distinguishing between those proposed to be removed and those proposed to be retained. (b) Existing and proposed ground levels. (c) Proposals for tree and shrub planting, including the size and species of each tree or shrub to be provided. (d) Proposals for the seeding or turfing of "soft" landscaped areas. (e) Details of the paving or other treatment of all hard surfaces. (f) Proposals for the protection of existing trees to be retained during construction works. (g) A programme for the implementation of the scheme. All planting, seeding, turfing, hard surfacing or other works comprised in such landscaping scheme as may be approved shall be carried out in accordance with the programme incorporated in the scheme. Any trees or plants which are removed, die or become seriously damaged or diseased within five years of planting shall be replaced in the next planting season with others of similar size and species to those originally required to be planted. REASON: To ensure that the site is adequately landscaped in the interests of the appearance of the locality. 9) The areas shown on the submitted plans for car parking, garaging and cycle parking shall be provided before the dwellings to which they relate are first occupied. Thereafter these areas shall be used or kept available for the parking of cars and cycles. REASON: The development without the provision of adequate parking space would be likely to lead to inconvenience and danger to road users by virtue of vehicles parked on the public highway and in the interests of sustainability. 10) Before the development commences a scheme shall be submitted to the local planning authority for approval showing temporary access to the site for the use of construction vehicles and showing measures to ensure that no mud or other debris will find its way onto the public highway. REASON: In the interests of highway safety. 11) The emergency access to the site shall be provided as part of the development hereby approved at a point in the build programme that has been approved by the local planning authority prior to the commencement of the development. REASON: In the interests of highway safety. 12) Before development commences details of the proposed on site storage of foul drainage, the proposed pumping system, the hours that the foul drainage will enter the existing system and the means by which the system will be monitored shall be submitted to and approved by the local planning authority. Any changes to the approved scheme shall be first approved in writing. REASON: To ensure that the site is adequately drained 13) Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order), none of the dwelling houses hereby permitted shall be extended nor shall any material alteration affecting their external appearance be made. REASON: Having regard to the high density of the development, extensions and alterations to the dwellings now permitted could result in loss of privacy and amenity to the occupiers of other residential units. 14) Before the commencement of any works in connection with the specific building concerned, details of the joinery and construction of the proposed windows and doors of that building (which may include look-a-like windows above the roof line) shall be submitted to and approved by the local planning authority. The development shall be carried out in strict accordance with the approved details. REASON: To ensure that the external appearance of the building does not prejudice the visual amenity of the neighbourhood. 15) Before the commencement of any works in connection with each building phase, samples/drawings of all rooflights, eaves, verges, jetties, chimneys / vents, bays, weatherboarding and window surroundings (window head, reveals, cills and architrave) for that building shall be submitted to and approved by the local planning authority. The development shall be carried out in strict accordance with the approved details. REASON: To ensure that the external appearance of the building does not prejudice the visual amenity of the neighbourhood. 16) Before the commencement of any works in connection with each building phase, detailed drawings of all balconies for that phase shall be submitted to and approved by the local planning authority. The balconies shall be erected in strict accordance with the approved details. REASON: To ensure that the external appearance of the building does not prejudice the visual amenity of the neighbourhood. 17) Before the commencement of any work in connection therewith, details of all rainwater goods shall be submitted to and approved by the local planning authority. The development shall only be carried out in strict accordance with the approved details. REASON: To ensure that the external appearance of the building does not prejudice the visual amenity of the neighbourhood. 18) No satellite dishes shall be placed on the face of any building fronting a public highway without the prior approval of the local planning authority. REASON: To safeguard the appearance of the development. 19) No work shall be commenced on any phase of the development until a sample panel of brickwork showing bonds, joints, pointing and mortar colour has been submitted to and approved by the local planning authority. The development shall be carried out in strict accordance with the approved sample panel. REASON: To safeguard the character of the development. 20) Before development commences a scheme shall be submitted to and approved by the local planning authority for compensation for loss of Flood Plain. This scheme shall be carried out prior to any land raising within the flood plain. REASON: To prevent Flooding 21) If during development, contamination not previously identified, is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the local planning authority, for an addendum to the Method Statement. This addendum to the Method Statement must detail how this unsuspected contamination shall be dealt with and from the date of approval the addendum(s) shall form part of the Method Statement. REASON: To ensure that the development complies with approved details in the interests of protection of the environment and harm to human health. 22) Upon completion of the remediation detailed in the Method Statement a report shall be submitted to the local planning authority that provides verification that the required works regarding contamination have been carried out in accordance with the approved Method Statement(s). Post remediation sampling and monitoring results shall be included in the report to demonstrate that the required remediation has been fully met. Future monitoring proposals and reporting shall also be detailed in the report. REASON: To protect the environment and prevent harm to human health by ensuring that the remediated site has been reclaimed to an appropriate standard. 23) Development approved by this permission shall not be commenced unless the method for piling foundations has been submitted to and approved in writing by the local planning authority. The piling shall thereafter be undertaken only in accordance with the approved details. REASON: The site is contaminated/potentially contaminated and piling could lead to the contamination of groundwater in the underlying aquifer. 24) Prior to being discharged into any water course, surface water sewer or soakaways system, all surface water drainage from parking areas and hardstandings shall be passed through trapped gullies with an overall capacity compatible with the site being drained. REASON: To prevent pollution of controlled waters. 25) No part of the development shall take place below the level of the existing fill until the applicant or the developer has secured the implementation of a programme of archaeological work in accordance with a written scheme of investigation which has been submitted to and approved by the local planning authority. REASON: To ensure a proper record of matters of archaeological interest. 26) Construction works shall only take place between 07.30 and 18.30 Mondays to Fridays and 07.30 to 13.30 on Saturdays with no activity at all on Sundays or Bank Holidays. This shall also include traffic movements including deliveries. Any works outside of these times shall on be with the prior written approval of the Local Planning Authority. REASON: In order to protect the amenities of surrounding occupiers. 27) Before the development commences a report with regard to traffic noise within the site as a result of the proposal including any mitigation measure shall be submitted to and approved by the local planning authority. The mitigation measures shall thereafter be implemented in accordance with the approved scheme. REASON: In order to protect the general environment and the amenities of surrounding occupiers. 28) Prior to any works being carried out to the trees identified in the bat survey report (dated 21 June 2006) which have potential to support roosting bats, a check for bat activity must be carried out immediately prior to works commencing. If bat activity is found associated with the trees, work must not proceed until a European Protected Species licence has been obtained. REASON: In the interests of the protection of bats 29) No works shall commence until a detailed mitigation strategy for reptiles present on the site is submitted to and approved in writing by the local planning authority. The works shall then proceed in accordance with the agreed strategy with any modification agreed in writing with the local planning authority. The mitigation strategy shall also contain a management strategy to ensure the conservation of the reptiles in the long-term, either on the site or at the off-site receptor area. REASON: In the interests of the protection of reptiles 30) Prior to the commencement of development, a scheme of biodiversity enhancements, as detailed in section 4.4 of the preliminary ecology report and also the reptile and bat survey report, dated 21 June 2006, and the riparian habitats survey, dated 20 June 2006 shall be submitted to and approved in writing by the local planning authority. The identified enhancements shall be carried out in full and in accordance with the programme included within the approved scheme. REASON: In the interest of ecology 31) Details of the design of the proposed road bridge and pedestrian bridge shall be submitted to and approved by the local planning authority before works commence thereon. The bridges shall be constructed in accordance with the designs approved. REASON: No such details have been submitted 32) Detailed plans of the public art for the site shall be submitted to the local planning authority for approval in accordance with the requirements and timetable for delivery set out in the section 106 legal agreement that forms part of this planning permission. REASON: To ensure that suitable public art is provided on the site in accordance with the council's public art policy 33) Details of the proposed fishing platforms shall be submitted to and approved by the local planning authority before works commence thereon. They shall be constructed in accordance with such plans as are approved. REASON: No such details have been submitted. 34) Details of the proposed play equipment shall be submitted to and approved by the local planning authority before works commence. REASON: No such details have been received 35) The details shown in the accessibility statement for any phase shall be submitted on a drawing and approved by the local planning authority before works commence on that phase. Such details that are approved shall be carried out as part of the development. REASON: In the interests of accessibility for all in and around the site. 36) An EcoHomes rating of very good shall be achieved across the site. Plot nos. 50 to 51 and 55 to 63 shall achieve an excellent rating. REASON: In order to achieve a sustainable development. 37) Details of the service margins along the link road fronting Kingsmead Park and fronting plots 132 - 155 including the section between plots 158 &159 shall be submitted to and approved by the local planning authority before works commence. REASON: In order to provide adequate service provision. 38) The submitted refuse collection plan shall be fully implemented and thereafter retained as part of the development. REASON: In the interests of the local environment. |

This decision to grant planning permission subject to conditions has been made having regard to the 1996 Kent Structure Plan and the 1998 Canterbury District Local Plan and specifically the policies and material considerations set out in the report of the Head of Development Services to the Development Control Committee on 27th June 2006 The Local Planning Authority draws attention to the fact that there is a Section 106 legal agreement/undertaking in respect of this planning permission. The planning permission provides only limited off-street parking space for the residential units and therefore not all the units will have the benefit of a parking space. Purchasers of residential property granted by this permission should therefore check with the developer as to whether there are on-site parking rights associated with their prospective property or whether it is a car-free unit. Puchasers are also advised that in areas of on street parking control, occupiers of this development will not necessarily be eligible for a resident's parking permit. |
